To the Honorabel the Speaker and Gentlemen of the House of Assembly of the State of Virginia

The Memorial of Joseph Nevill Humbly Shewith That Alexander Rooney was possest in Feesimple of a tract of land of about four hundred Acres Situated Lying and being (now in the County of Randolph). That in the year (sic) the Indians Killed the said Alexn Rooney and took his wife Catharine and Son Alexn the only Child and heir Prisoner, and that in retaking the said Catharine our people unfortunately Shot the Son through the Head, by which means the said Catharine became Sole Heir to the said Tract of land. That the said Catharine some time after intermarried with a certain John Monks. Since which the said Catherine Died and the said Monks Intermarried with a Certain Isabella Trent. That the said John Monks being now possesed of the four hundred acres of land above mentioned agreed with your Memorialist to give him the said tract of land of four hundred acres for a small Farm of your Memorialist during the natural lives of them the said John Monks and Isabella his wife to which your Memorialist agreed, and the said Monks furnished your Memorialist with the Original Deed in order to have the ness necessary writings drawn.-But so it happened that through the neglect of your Memorialist and the untimely death of the said John Monks this was not done. Which unfortunate Circumstance your Memorialist is under the necessity of Troubling your Honorable Body Hoping you will take the same into consideration and give him Such relief as your House shall think Right. Saveing to the Heirs of 'Alexn Rooney (If any shall appear) their Right. And your Memorialist is in duty bound.

Robert Gibbony and Mary Gibbony came before me ________ ________ a Justice of the peace for the County of Hardy and made oath that John Monks who married the widow of Alexander Rooney did about Thirteen or Fourteen year ago Sell and Completely dispose of all their right of a Tract of land laying in Randolph County containing about four hundred acres unto General Joseph Nevill and that the consideration was a _______place of the said Genl Joseph Nevill for a during the life of John Monks & his wife-who is ________ of said agreement moved on the place and continued in possession for and during their Lives that John Monks promised a complete conveyance to Joseph Nevill and, that Monks remained in full enjoyment of his agreements. Your deponents further say that John Monks died from home some time in the year 1793 or 1794.
